S3 STRENGTH AND FITNESS LIABILITY WAIVER AND MEMBER AGREEMENT

PLEASE READ CAREFULLY – THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS

By signing this agreement, I acknowledge and agree to the following terms and conditions as a member or guest of S3 Strength and Fitness (“Facility”), owned and operated by Berserker Powerhouse LLC (“Company”):

1. ASSUMPTION OF RISK

I understand that participation in gym activities, including but not limited to weightlifting, cardiovascular exercise, use of machines, cold plunge, sauna, and other physical activities, involves inherent risks. These risks include, but are not limited to, serious injury, illness, permanent disability, or death.

I voluntarily assume all risks associated with my participation and use of the Facility.

2. RELEASE OF LIABILITY

I hereby release, waive, and discharge Berserker Powerhouse LLC, S3 Strength and Fitness, its owners, employees, contractors, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to any injury, damage, or loss I may sustain while using the Facility.

3. 24/7 ACCESS AND MEMBERSHIP USE

I understand that this is a 24/7 access facility. I agree that:

• My membership is for my personal use only.

• I will not allow any other individual to use my access or enter the Facility using my membership.

• Violation of this policy will result in immediate revocation of my membership without refund.

4. VIDEO SURVEILLANCE

I acknowledge and understand that:

• The Facility is monitored by video surveillance for safety and security purposes.

• By entering the Facility, I consent to being recorded at all times.

5. EQUIPMENT RESPONSIBILITY

I agree to:

• Use all equipment properly and safely.

• Be financially responsible for any damage to equipment caused by my negligence, misuse, or intentional actions.

6. PERSONAL PROPERTY

I understand that:

• I am solely responsible for my personal belongings.

• Berserker Powerhouse LLC and S3 Strength and Fitness are not responsible for lost, stolen, or damaged items left in or around the Facility.

7. RECORDING AND PRIVACY

I agree that:

• I will not photograph, video record, or otherwise capture images or recordings of other members without their explicit consent.

• Violation of this policy may result in termination of membership.

8. COLD PLUNGE USE

I understand and acknowledge that:

• The Facility offers a cold plunge (body of water).

• There is NO lifeguard on duty.

• I enter and use the cold plunge entirely at my own risk.

• I am responsible for assessing my own physical condition prior to use.

9. SAUNA USE

I understand and acknowledge that:

• The Facility offers a sauna.

• Use of the sauna is entirely at my own risk.

• I should consult with a physician prior to use, especially if I have any medical conditions.

10. MEDICAL ADVICE AND HEALTH CONDITIONS

I acknowledge that:

• I am responsible for consulting with a physician before participating in any exercise program, including the use of the cold plunge, sauna, or consumption of supplements or energy drinks.

• I certify that I am physically capable of participating in gym activities.

11. ENERGY DRINKS AND SUPPLEMENTS

I understand and agree that:

• Any consumption of energy drinks or supplements at or associated with the Facility is done at my own discretion and risk.

• I am responsible for ensuring that I am able to safely consume such products.

• Berserker Powerhouse LLC and S3 Strength and Fitness are not liable for any adverse effects resulting from consumption.

12. INDEMNIFICATION

I agree to indemnify and hold harmless Berserker Powerhouse LLC and S3 Strength and Fitness from any claims, damages, or expenses resulting from my actions, negligence, or violation of this agreement.

13. ACKNOWLEDGMENT AND AGREEMENT

I have read this waiver in full, understand its terms, and acknowledge that I am giving up certain legal rights, including the right to sue.
